Justice Alito questioned Solicitor General Verrilli about what the PSD permitting process would look like for greenhouse gases.  Justice Alito expressed his view that it would make “no sense to try to assess the effect of the emission of greenhouse gases” on a particular area in a region.  Solicitor General Verilli countered with his detailed and thorough explanation of the permitting process and analysis for assessing the effect of greenhouse gases on an area.  He ended by saying that, given the EPA’s regulatory obligations, “it made the most reasonable choice available to it.”
