Farewell to Fundamentals

Crawford v. Marion County Election Board - Decision 04/28/08

In the past, the Supreme Court has classified the right to vote as fundamental, even going so far as to say that voting may be the most fundamental right, as its exercise is necessary to secure all other rights. But a majority of the Roberts Court seems to have other ideas.  In its recent decision in Crawford v. Marion County Election Board, a plurality of the Court voted to uphold Indiana’s voter ID law—the most restrictive voter ID law in the country.
