The Code of Conduct for U.S. Judges, which requires judges to “act at all times in a manner that promotes public confidence in the integrity and impartiality of the judiciary” and explicitly bans political activity, shockingly does not apply to the Supreme Court. Just as surprisingly, Supreme Court justices who have been asked to step aside from a case make their decisions alone, in secret, and with no possibility of review by their peers or any other authority.

Holding the Supreme Court to a lower ethical standard undermines the Court’s appearance of independence and impartiality. That’s why AFJ is calling on the Court to adopt the same rules that hold sway in every other federal courtroom.
