Protect our most vulnerable senior citizens from forced arbitration.
We’ve told you about the enormous harm done by forced arbitration – the pernicious practice that shuts you out of court when you’ve been wronged – in consumer and employment contracts.
But forced arbitration is at its worst when it’s used against the most vulnerable people in America – especially senior citizens in nursing homes. Imagine having a loved one abused or neglected by the very place entrusted with their care, only to find out that you can’t hold the institution accountable in court. Instead you must go before a private arbitrator effectively chosen by the nursing home itself.
But there’s some good news: Almost all nursing homes get some of their money from Medicaid and Medicare. That makes them subject to federal regulations. And right now, the federal Centers for Medicare and Medicaid Services is considering regulations to reform forced arbitration.
