Washington, DC, September 29, 2016– In response to the Centers for Medicare and Medicaid’s announcement of a rule barring forced arbitration requirements in contracts at nursing homes that accept federal funds, Alliance for Justice President Nan Aron issued the following statement:

“We are extremely gratified to see CMS acting to end the terrible practice of forced arbitration imposed on nursing home residents and their families.   The abuse of this practice at nursing homes, where residents and families may be ill or in distress and unaware they have signed away their right to go to court if they have a complaint, has always been especially egregious.  We applaud CMS for putting nursing home residents’ safety first, and for joining the growing ranks of government agencies, including the Department of Defense and Department of Labor, that have banned forced arbitration in contracts with their vendors.”

AFJ previously submitted comments to CMS urging the agency to ban forced arbitration in nursing homes.
