AFJ Condemns Partisan, Discriminatory Speech By Justice Alito

WASHINGTON, D.C., November 13, 2020 – Thursday night, Justice Samuel Alito gave a blisteringly partisan speech to the conservative Federalist Society. His remarks included objections to COVID-19 restrictions, access to contraception, and marriage equality and LGBTQ nondiscrimination protections. On each of these issues, he framed conservatives as victims for being expected to treat others safely and equally. He likewise directly attacked several Democratic senators, abandoning any pretense of impartiality.

Alliance for Justice President Nan Aron issued the following statement:

“Justice Alito’s endorsement of bigotry and disregard for vital COVID health protections speak to how radically partisan this Supreme Court has become. His egregious comments are also a stark reminder that there is no code of ethics governing the Supreme Court.

Supreme Court justices are not supposed to be criticizing what senators from a particular party have to say. It’s likewise absurd to claim that those who would refuse service are themselves victims or that it’s okay for a bakery to discriminate against a same-sex couple just because a bakery down the street will serve them. And we all have a role to play to protect each other from the coronavirus that is once again surging across the entire country with increasingly deadly results. The judiciary must be fair and impartial, not one where justices glibly endorse bigotry over science in public speeches and then expect to be trusted to protect civil rights and uphold the rule of law.

Knowing what Justice Alito has written in his opinions — thankfully often in dissents — these positions are not entirely surprising. Still, it is shocking that he would openly admit that he will not objectively consider the cases that come before him. We deserve justices who will stand up for all people, not just those who agree with their personal political agenda.”
