Controversy is also swirling around Justice Samuel Alito after the leak in May of a draft decision he wrote striking down Roe v. Wade, the 1973 decision that affirmed abortion as a right. More recently, the New York Times reported that a former anti-abortion leader claims that in 2014 another decision — written by Justice Alito in the case of Burwell v. Hobby Lobby, which concerned a federal employer contraception coverage mandate — leaked early after the jurist had a private dinner with like-minded conservative activists. Justice Alito denies any wrongdoing.
And as we’ve noted before, a report from the Alliance for Justice found questionable behavior among several other justices.
