WASHINGTON, D.C., February 26, 2019 – Following today’s vote in the Senate to confirm Eric Miller to a seat on the Ninth Circuit Court of Appeals, over the objections of both senators from his home state of Washington, AFJ President Nan Aron released the following statement:

“Eric Miller’s confirmation to the Ninth Circuit is an historic first – and not in a good way. The Congressional Research Service has found no other instance in which a federal appeals court nominee has been confirmed over the objections of both of his or her home-state senators. With this vote, Republicans have put another nail in the coffin of the Senate’s constitutional advise-and-consent role to make way for a Trump judicial nominee who has a deplorable record, especially on Native American rights and issues. This is disgraceful.”
