WASHINGTON, D.C., November 10, 2020 – This morning the Supreme Court heard oral arguments in California v. Texas, the case brought by Republican state attorneys general and supported by the Trump administration to try to overturn the Affordable Care Act.
Alliance for Justice President Nan Aron issued the following statement:
“Biden may have won the election, but we are not out of the Trump forest yet. The president told us he would nominate Supreme Court justices ready to overturn the Affordable Care Act, and that’s exactly what he did. Justice Neil Gorsuch had previously ruled against the law’s contraception mandate, Justice Brett Kavanaugh previously produced a ‘roadmap’ for overturning the law, and Justice Amy Coney Barrett — who has only been sitting for cases for a week — is on record as saying she supports overturning the law.
The Justice Department joined Republican attorneys general in calling for the Court to overturn the law in its entirety. That would immediately deprive millions of health insurance and eliminate protections for preexisting conditions — to say nothing of the other great benefits like parental coverage up to age 26.
If the Supreme Court throws out the ACA for millions of people by overturning the law, it should eliminate any remaining doubt that it is a partisan, political body just like the other two branches of government — except without any accountability to voters.”
